Judicial Process: Cases and Materials (Coursebook)

Judicial Process is the perfect accompaniment to field placements and their classroom components. Designed specifically to complement a student’s judicial internship, Judicial Process explores both the practical and theoretical aspects of clerking. Coverage includes practical skills and concepts interns must master, including knowledge of court structures and procedure, the role of the clerk in chambers, memo and opinion writing, ethical considerations, statutory interpretation, common law reasoning, and constitutional interpretation. Simultaneously, the book explores theoretical topics in the American judicial system, including the judicial decision-making process; judicial power and independence; judicial selection, conduct, and discipline; administrative, problem-solving, and international tribunals; alternatives to traditional litigation; and bias in the system.

The text includes cogent explanation, crisply edited cases, and thought-provoking questions designed to generate classroom discussion and guided reflection. Written by faculty with more than 20 years of experience teaching experiential courses and their classroom components, Judicial Process integrates the doctrine, theory, skills, and ethics required for all field placements.
