本书为陈卫东教授主持的中欧法律与司法合作项目“刑事诉讼法再修改”课题的最终成果。该课题自2004年3月27日启动，为期一年，其间经过实地调研、欧洲考察、内部论证、专家论证研讨会等多项活动，四易其稿，形成了《模范刑事诉讼法典》一书。全书分为条文、参考立法例与立法理由论证三部分。《模范刑事诉讼法典》是迄今为止国内学者起草的第一部刑事诉讼法典，包括8编、662个条文，总字数达到86589字。“模范”二字昭示着这部法典的前瞻性与理想性。在反思刑事诉讼法修改八年以来暴露的种种弊病、参酌八年来诉讼法学界学术研究的优秀成果之基础上，《模范刑事诉讼法典》为刑事诉讼法的再修改树立了一座航标。
