§ 1 Scope

(1) These General Terms and Conditions apply to purchase contracts concluded between Versandantiquariat Dennis Wolter (hereinafter referred to as the “Seller”) and customers via the AbeBooks and ZVAB platforms operated by AbeBooks Europe GmbH.

(2) AbeBooks provides the platform and facilitates the purchase contracts. The Seller and the Buyer are the contracting parties to the purchase contract.

(3) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or self-employed professional activity (§ 13 German Civil Code – BGB).

(4) An entrepreneur is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the course of their trade, business or self-employed professional activity (§ 14 BGB).

(5) Any deviating terms and conditions of the customer shall apply only if the Seller has expressly agreed to their application.

§ 2 Conclusion of the Contract

(1) The presentation of goods on AbeBooks/ZVAB takes place within the ordering and brokerage system provided by AbeBooks.

(2) By completing the ordering process via AbeBooks/ZVAB, the customer submits an order for the selected goods. Further processing and conclusion of the contract take place in accordance with the ordering procedure provided by AbeBooks. The Seller processes orders transmitted to it using the functions provided by AbeBooks for this purpose.

(3) The contractual language is German.

(4) The order data are processed within the technical functions of AbeBooks/ZVAB and transmitted to the Seller. The functions and terms provided by AbeBooks apply with regard to the permanent availability of order and contract data within the platform.

§ 3 Prices, Shipping Costs and Delivery

(1) The prices stated are final prices and include the VAT payable by law.

(2) Any additional shipping costs are indicated in the respective offer and/or during the ordering process.

(3) Delivery is available to the countries offered in the respective listing and/or during the ordering process.

(4) For deliveries to countries outside the European Union, additional import duties, customs duties, taxes or fees may be incurred which are not levied by the Seller. Where such costs are payable by the Buyer under the applicable legal provisions and unless expressly agreed otherwise, they shall be borne by the Buyer.

(5) The applicable delivery time is stated in the respective offer and/or during the ordering process.

§ 4 Terms of Payment

(1) The customer may use the payment methods offered during the respective ordering process on AbeBooks/ZVAB.

(2) Where payment is processed through a payment service provider used by AbeBooks, payment shall be processed in accordance with the applicable terms and conditions of that service provider.

(3) Where the Seller directly offers payment by invoice, the invoice amount shall be payable without deduction within 14 days of receipt of the goods and the invoice, unless a longer payment period is stated on the invoice.

(4) Where advance payment has been agreed, the purchase price shall become due after conclusion of the contract and receipt of the payment information.

(5) The customer's statutory rights of set-off and retention remain unaffected.

§ 5 Right of Withdrawal for Consumers

Consumers have the statutory right of withdrawal. Details are set out in the separate withdrawal instructions provided on AbeBooks/ZVAB.

§ 6 Return Shipping Costs in the Event of Withdrawal

The consumer shall bear the direct costs of returning the goods unless otherwise stipulated in the withdrawal instructions or expressly agreed otherwise.

§ 7 Condition and State of the Goods

(1) The Seller's range consists predominantly of used and antiquarian books, periodicals and other printed matter.

(2) The condition of the respective goods is determined by the specific item description. Age-related and usage-related characteristics, in particular signs of use, yellowing, stamps, handwritten annotations and damage to bindings or paper, are described insofar as they are material to the assessment of the respective item.

(3) Images are for illustrative purposes. Where images and the item description differ, the specifically agreed characteristics shall prevail. The customer's mandatory statutory rights remain unaffected.

(4) The foregoing provisions do not constitute a general restriction of statutory rights in respect of defects. Deviations from the objective requirements applicable to the goods shall be agreed with consumers only in accordance with the applicable statutory requirements.

§ 8 Liability for Defects (Statutory Warranty)

(1) The statutory law governing liability for defects applies.

(2) The statutory limitation periods for claims relating to defects apply to consumers. No shortening of the limitation period for used goods is agreed.

(3) In relation to entrepreneurs, the limitation period for claims relating to defects shall be one year from the commencement of the statutory limitation period. This reduction shall not apply to claims arising from injury to life, body or health, intentional or grossly negligent breaches of duty, fraudulent concealment of defects, or claims under the German Product Liability Act. The statutory limitation periods apply to such claims.

(4) The statutory duties of inspection and notification pursuant to § 377 of the German Commercial Code (HGB) remain unaffected.

§ 9 Liability

(1) The Seller shall be liable without limitation in cases of intent and gross negligence, for damages arising from injury to life, body or health, under the German Product Liability Act and to the extent of any expressly assumed guarantee.

(2) In the event of a slightly negligent breach of an essential contractual obligation, the Seller's liability shall be limited to the foreseeable damage typical for the contract. Essential contractual obligations are obligations whose fulfilment is necessary for the proper performance of the contract and on whose observance the customer may regularly rely.

(3) In all other respects, liability for damage caused by slight negligence is excluded to the extent permitted by law.

(4) The foregoing limitations of liability shall also apply for the benefit of the Seller's legal representatives and agents.

(5) Mandatory statutory liability provisions remain unaffected.

§ 10 Retention of Title

The goods shall remain the property of the Seller until the purchase price has been paid in full.

§ 11 Alternative Dispute Resolution

The Seller is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

§ 12 Choice of Law and Jurisdiction

(1) German law shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

(2) In relation to consumers, this choice of law shall apply only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which they have their habitual residence under the applicable rules of private international law.

(3) If the customer is a merchant, a legal entity under public law or a special fund under public law, the court having jurisdiction at the Seller's registered place of business shall have exclusive jurisdiction over all disputes arising from the contractual relationship, insofar as permitted by law.

(4) Mandatory statutory provisions governing jurisdiction remain unaffected.
