London : William Maxwell, 1865. 2nd edition. Contemp. cloth binding. xvi,410,lxxxix pp. 20x14 cm. Binding bit rubbed. Hinges weak & repaired. Else very good copy in original state. - This nineteenth-century legal treatise provides a systematic introduction to the principles, doctrines, and jurisdiction of English equity law. Based on a series of lectures delivered at the request of the Incorporated Law Society - the professional body of English solicitors founded in 1825 and later renamed The Law Society - this work was intended as an educational guide for students and practitioners. Equity developed in England alongside common law to mitigate the rigidity of legal rules that could produce unjust outcomes. Administered through the Court of Chancery under the authority of the Lord Chancellor, equity relied upon principles of fairness, conscience, and good faith. It created distinctive remedies and doctrines, including injunctions, specific performance, trusts, fiduciary obligations, rectification and rescission of contracts, and protection against fraud and abuse of confidence. The author, Freeman Oliver Haynes (c. 1818-1880), was a barrister of Lincoln’s Inn and a specialist in equity and conveyancing. Educated at Gonville and Caius College, Cambridge, where he graduated in 1840 and became a Fellow in 1843, he was called to the Bar in 1845. Haynes discusses the historical development of equity, its jurisdiction, and its practical application in areas such as trusts, mortgages, fraud, mistake, and equitable remedies. The book also examines the relationship between common law and equity during a period when both systems remained institutionally separate. Published in 1865, only a few years before the Judicature Acts of 1873-1875 merged the administration of common law and equity, the volume documents a legal system at a crucial transitional moment. As such, it constitutes an important source for the study of Victorian legal education, the history of the Court of Chancery, and the foundations of modern trust and fiduciary law.
