ان التعديل الهادف لأحكام الدستور هو السبيل الوحيد لإعادة بث الروح في نظام سياسي متهالك ومتداعي، اندثر فيه مبدأ استمرارية السلطة إلى أبعد حدود، مما جعله يُقذف بكل هضيمة ويبّز بكل عظيمة، حتى بات يوحي للبعض المتكالب على دفنه والساعي لإحياء مشاريع الانعزال والانعتاق والاستقواء والإلغاء انه يلفظ أنفاسه الأخيرة، فلا ريب أن ورشةً ترميميةً للهيكل تقيه السقوط أمست حاجة ملحة فيَخضرَّ عودُه ويَصلُبَ عَمودُه.

ولا شك أن هذا التعديل المقترح يلامس مختلف نواحي النص، فيوضح ويعزز بعض المسائل الجوهرية الـمُقرّة والمكرّسة في فلسفة النظام وفي مجال الحقوق والحريات كما انه يمتدّ بطبيعة الحال إلى السلطات التشريعية، التنفيذية، والقضائية، ليتناول بعض نواحي تكوينها وصلاحياتها وعلاقاتها فيمَا بينها.

لقد أدخل الإصلاح الدستوري لعام 1990 مقدمة على الدستور ضّمنها فلسفة النظام السياسي في لبنان والأسس التي يرتكز عليها فضلًا عن تكريسه للحقوق والحريات التي يتمتع بها اللبنانيون أفرادًا وجماعات والتي يضاف إليها ما ورد في متن الدستور اصلًا في المواد 7 إلى 13 منه. ومن نافل القول إن هذه المقدمة وامتدادها لناحية هذه الحقوق تشكل العامود الفقري للتكوين الدستوري اللبناني ويقتضي إبقاؤها منزّهة عن التعديل أو التحريف لما تختزنه من مبادئ عامة جوهرية. إلا أن هذه المسلّمة لا تغني عن إدخال بعض التعديلات الموضعية بغية إشاحة الغموض حول بعض البنود التي بيّنت الممارسة تشويهًا لمضمونها يكرس التعطيل، فضلًا عن تعزيز بعض الحقوق والحريات الأمر الذي ينسحب حتمًا على السلطة القضائية والمجلس الدستوري بفعل أن حق ولوج قضاءٍ مستقلٍ يشكل مدخلًا حتميًا للتمتع بالحقوق كافة.
