Formerly, when the plaintiff in his replication con 'cluded to the country, or demurred, the issue could not have been made up, till a four-day rule had been given and expired, to rejoin, or join in demurrer; but the practice in that respect is now altered, it being a rule, that in all Special pleadings, where the plaintiff takes issue Upon the defendant's pleading,or traverses the same, or demurs, SO as the defendant is not let in to allege any new\matter, the plaintiff may make up the paper-book, without giving a rule to rejoin 6: but otherwise a rule must be given for that purpose, um~ less the defendant be bound, by a judge's order, to rejoin gratis.
