Synopsis

The 1951 Refugee Convention is the fundamental instrument of international refugee protection. Nevertheless, the Convention was criticized in many aspects, specially - it was pointed out that the Convention does not cover gender based refugee claim. Women are neglected in the Convention. UNHCR issued Gender Guidelines and Handbook for women refugee. UK, Canada, Australia and US, and some other states adopted guidelines to consider the application of women refugee. Case laws also contributed to its development. However, still the question is, whether these developments are sufficient to ensure the rights of women refugee, who are persecuted for their gender.
