Warda, an attorney, addresses what he sees as a tort and liability system that has run amok. He charges that law professors and judges have conspired to use the legal system to siphon off money from businesses to lawyers and their clients. In his view, juries are little more than pawns whose emotions can be manipulated so that millions of dollars can be doled out to avaricious clients and their unscrupulous advocates. Warda reviews areas of potential liability and useful techniques for protecting assets. While he offers a fairly complete summary of issues, some of his advice is extreme. In the chapter entitled "Avoiding Risk," he warns against volunteer activities, mentioning a claim against the Boy Scouts in which two volunteers at an outing where a child was severely injured were found negligent. One wonders whether the number of judgments against scouting organizations justifies discouraging participation. Contrasting treatment can be found in Jay Mitton and Ginita Wall's Cover Your Assets: Lawsuit Protection (LJ 9/1/95). Their chapter entitled "The Dangers of Volunteer Work" notes the risks but lists steps that can be taken to allow individuals to serve a charity with some peace of mind.
