Light rubbing and a few minor spots to boards, spine ends bumped, corners bumped and lightly worn, front hinge cracked, early owner signature of Carroll Cutler, dated 1867, to front free endpaper, another Cutler signature and later inscription by his wife to front endleaf, a few spots of glue residue to title page along gutter. $95. * First edition. An historical analysis of how primitive and medieval European legal systems relied on irrational beliefs and divine intervention to determine guilt or innocence. The author argues that these early practices demonstrate the power of superstition and its deep intertwining with legal authority. One of the first scholarly studies of ancient modes of proof: wager of law, wager of battle, the ordeal and torture. Lea's vast scope includes ancient and non-Western examples. The book highlights the influence of these practices on the evolution of law and the lingering impact of these early belief systems on modern society. It serves as a foundational text in the study of medieval history and the development of jurisprudence. The former owner of this copy, Caroll Cutler [1829-1894], was the fourth president of Western Reserve College, now Case Western Reserve University.
