Négociant pour le compte de la firme « Veuve Antonio Merlino et fils » qui contribua notamment au financement de l'encyclopédie, il fit plusieurs voyages en Italie et rédigea un mémoire sur l'exploitation de la soie dans la péninsule. La cinquantaine avancée, il entreprit des études de droit pour acquérir une charge de conseiller de la Sénéchaussée de Trévoux. Il s'installa à Fareins et eut des démêlés, qui contribuèrent à sa notoriété, avec une secte convulsionnaire animée par le curé Bonjour. Ce combat, par bien des aspects rocambolesque, excita la verve des érudits locaux mais contribua surtout à sa notoriété en lui permettant d'élargir progressivement ses mandats électifs : recteur de la fabrique de Fareins puis premier consul et délégué de sa paroisse à l'assemblée sénéchale lors de la convocation des États généraux, commissaire à la rédaction du cahier de doléances du Tiers état de la sénéchaussée, administrateur du district de Trévoux, juge au tribunal du district puis au tribunal criminel du département de l'Ain à Bourg-en-Bresse. Élu le 6 septembre 1792 dernier député de l'Ain à la Convention nationale, il fut membre du Comité de défense générale, préfiguration du grand Comité de salut public. Il exerça sous la Convention une activité très soutenue marquée par une grande assiduité dans plusieurs comités (commerce, agriculture, guerre, secours) et dans différentes commissions (commission des six sur les subsistances, commission des seize sur la nouvelle Constitution, commission Garran de Coulon sur l'esclavage). On lui doit en particulier la mise en oeuvre de l'embrigadement2 qui consistait à rassembler au sein d'une demi-brigade un bataillon de ligne avec deux bataillons de volontaires, un plan d'organisation du gouvernement3 qu'il rédigea avec Romme et Thibaudeau. Il intervint plus d'une soixantaine de fois à la barre de la Convention dont il fut secrétaire le 1er messidor an II (19 juin 1794). Merlino fut partisan, comme Vergniaud, girondin notoire, de l'appel au peuple6 ce qui lui fut reproché par certains montagnards comme Ichon7, 31 juillet 1794) et il participa aux journées de thermidor s'opposant à des robespierristes comme Jagot. Plus tard, il s'illustra au club de Noailles qui regroupait des montagnards modérés comme lui. Il resta cependant fidèle à des convictions tranchées ce qui explique la complexité du personnage. Son opposition au clergé, nourrie et développée contre la secte fareiniste en est le meilleur exemple. Il dénonça le 2 frimaire an II (22 novembre 1793) « l'horizon de la France obscurci par une nuée de prêtres » et, après thermidor, le 5 vendémiaire an II (27 septembre 1794), il s'élevait encore au Club des jacobins, dont il faisait partie depuis le 26 septembre 1792, contre la nomination des prêtres et des nobles à des emplois publics. Dans le même temps il dénonça8, alors que ce n'était plus de saison, d'anciens girondins comme l'écrivain Louis-Sébastien Mercier pour son comportement anti-républicain. Son hostilité à l'esclavage a été mise en lumière par Dorigny et Gainot qui soulignent notamment : « Il est tout à fait symptomatique de voir grandir au sein de la société l'influence de plusieurs personnalités de premier plan de cette opposition parlementaire comme Duplantier, Deydier et surtout Merlino. C'est ce dernier que les rapports de police présentent comme membre actif des réunions qui cherchent à articuler opposition législative et opposition néo-jacobine extra-parlementaire. » Jean-Marie François Merlino mourut le 16 octobre 1805 dans sa propriété du Graberet à Fareins, dans l'Ain, où sa tombe existe encore.

In-octavo broche, 43 pages - L'hospice des Quinze-Vingts a été fondé vers 1260 par saint Louis sans que l'on connaisse le détail et l'époque précise de cette fondation. Il était alors situé rue Saint-Honoré au coin de la rue Saint-Nicaise1, sur une pièce de terre appelée « Champourri »2. Le nom de Quinze-Vingts veut dire trois cents (15 × 20 = 300) dans le système de numération vicésimal et, de fait, l'hospice comprenait trois cents lits. Le but était de recueillir les pauvres aveugles de Paris, des deux sexes, qui étaient fort en détresse. « Aussi li benoiez roys fit acheter une piece de terre de les Saint-Ennouré, où il fist fere une grant mansion porce que les poures avugles demorassent ilecques perpetuellement jusques à trois cents ; et ont tous les ans de la borse du roy, pour potages et autres choses, rentes. En laquelle méson est une église que il fist fere en l'eneur de saint Remi, pour que lesditzs avugles oients ilecques le service Dieu. » Cette création a conduit directement à la fondation d'autres maisons d'aveugles, mais à l'initiative de bourgeois de la ville, comme l'hospice des Six-Vingts de Chartres ou celle de l'hôpital Jean-Rose de Meaux. Louis IX aurait fait bâtir cette maison pour porter secours à 300 chevaliers faits prisonniers par les Sarrasins durant la septième croisade, et qui eurent les yeux crevés avant d'être libérés. Toutefois Jean de Joinville n'en parle pas, et aucune source de l'époque ne l'atteste. Selon l'historien des Quinze-Vingts, Léon Le Grand, il s'agirait d'une légende apparue au xvie siècle. Le pape Clément IV recommanda cette institution aux prélats dans une bulle datée de 1265, en les invitant à apporter leurs dons 2. En effet, en contrepartie de leurs privilèges (hébergement, nourriture et habillement), les pensionnaires des Quinze-Vingts devaient prier pour la famille royale, les bienfaiteurs et donateurs de l'hospice. Il s'agit d'une économie de don, basée sur l'échange (don et contre-don), la foi et la confiance. Le travail des pensionnaires est de prier pour les donateurs qui obtiennent en retour le salut de leurs âmes. La gestion de l'établissement semble toutefois avoir laissé à désirer : « Je ne sais trop pourquoi le roi a réuni dans une maison trois cents aveugles, qui s'en vont par troupes dans les rues de Paris, et qui, pendant que le jour dure, ne cessent de braire. Ils se heurtent les uns contre les autres, et se font de fortes contusions ; car personne ne les conduit. Si le feu prend à la maison, il ne faut pas en douter, la communauté sera entièrement brûlée, et le roi obligé de la reconstruire à de nouveaux frais. » En 1779, sous le règne de Louis XVI, le cardinal de Rohan fit transférer l'établissement rue de Charenton, dans le faubourg Saint-Antoine. Par lettres patentes du 16 décembre 1779, le roi ordonne la création de plusieurs rues à l'emplacement de l'ancien hôpital des Quinze-Vingts : rue de Beaujolais-Saint-Honoré, rue de Chartres-Saint-Honoré, rue de Montpensier-Saint-Honoré, rue des Quinze-Vingts, rue de Rohan, rue de Valois-Saint-Honoré8. Toutes ces rues, à l'exception de la rue de Rohan, ont été supprimées lors du prolongement de la rue de Rivoli et l'achèvement du palais du Louvre dans les années 1850. L'hôpital est aménagé dans l'ancienne caserne des Mousquetaires-Noirs, qui avaient été supprimés en 1775. Le cardinal de Rohan modifia le système d'administration et porta le nombre d'aveugles à huit cents.

Cette pétition dénonce et expose l'opération de la vente frauduleuse de l'Hôpital, de son enclos, rue Saint-Honoré et de deux maisons réalisées par le Cardinal de Rohan sans l'accord des frères de l'Hôpital des Quinze-Vingts et du clergé propriétaire des lieux et au détriment des malades. Louis-Edouard, prince de Rohan a été nommé, malgré l'inimitié de Marie-Antoinette, grand aumonier en 1777 et administrateur des Quinze-Vingts, cardinal (1778), évêque de Strasbourg (1779). Ses revenus dépassaient 2,5 millions de revenu. Constamment endetté, il continua à l'être, tant il avait un goût insensé pour le faste. Il fit transférer l'hospice des Quinze-Vingts, fondé par Louis XI, de la rue Saint-Honoré aux faubourg Saint-Antoine. En effet le bâtiment était devenu trop petit face aux nombre de pensionnaires et la proximité du cimetière le rendait insalubre. De plus, ce quartier était très prisé comme lieu d'habitation par la bourgeoisie et la Cour. Cette opération n'eut pas lieu sans grandes difficultés et, comme on connaissait la prodigalité du cardinal, on l'accusa de malversations et l'affaire fut portée devant le Parlement qui lui donna gain de cause. Après l'affaire du Collier de la Reine, qui le mena en 1785 à la Bastille, il se vit à nouveau accusé d'avoir dilapidé l'argent de son diocèse pour ses plaisirs et les anciens administrateurs des Quinze-Vingts le poursuivèrent pour malversation. En 1790, ses menées monarchiques contre la France révolutionnaire furent dénoncées à la Tribune, et une pétition (celle présentée ici) demanda, à nouveau, qu'on instruisit son procès, comme ayant vendu illégalement les terrains de la rue Saint-Honoré. Ces différents procès furent tous plus ou moins étouffés et l'affaire ne fut jamais parfaitement élucidée.
