Bleibt ein Mitwirkungsbeitrag des Bestellers aus, so kann der Unternehmer das Werk oftmals weder in dem geplanten Zeitraum noch mit dem geplanten Kostenaufwand vollenden. In diesen Fällen stellt sich für ihn die Frage, ob und unter welchen Voraussetzungen er vom Besteller eine Entschädigung für seinen Mehraufwand verlangen oder inwieweit er für bereits ausgeführte Leistungsteile die vereinbarte Vergütung beanspruchen kann, wenn diese vor Abnahme aufgrund eines nicht vertragsgemäÃen Mitwirkungsbeitrags des Bestellers beeinträchtigt werden. Trotz der erheblichen praktischen Bedeutung dieser Fragen ist die Zuweisung der Stà rungsfolgen, die ihre Ursache im Ausbleiben eines vertragsgemäÃen Mitwirkungsbeitrags des Bestellers haben, in der Rechtsprechung bis heute nicht abschlieÃend geklärt. Der Verfasser untersucht systematisch und umfassend die Mitwirkung des Bestellers beim Werkvertrag sowie die Rechtsfolgen eines Ausbleibens vertragsgemäÃer Mitwirkung. Er entwickelt eine Là sung, die sich an den Vorschriften des Annahmeverzugs orientiert und die eine sachgerechte Zuweisung der Stà rungsfolgen erlaubt. Die Untersuchung setzt bei den Grundlagen des Annahmeverzugs nach den Vorstellungen der Verfasser des BGB von 1900 an und verdeutlicht, dass die Regelungen des Annahmeverzugs bei konsequenter Fortentwicklung auch die Là sung der heutigen Probleme infolge nicht vertragsgemäÃer Mitwirkung beim Werkvertrag ermà glichen.
