El presente libro aborda, desde un esquema expositivo claro y sencillo, la ejecución de las penas en España ?muy especialmente, la de prisión?, recorriendo sus diferentes fases, desde la incoación de la ejecutoria hasta el licenciamiento definitivo del condenado, para va…lorar, en cada una de ellas, si la reinserción social sigue constituyéndose como la principal aspiración de la intervención penitenciaria o ha cedido su espacio o protagonismo a otras finalidades diversas. Por tanto, el trabajo va más allá del análisis descriptivo del modelo de ejecución de la pena dispuesto en la norma, al realizar un juicio valorativo del mismo, de sus objetivos y sus aspiraciones últimas. Se trata de corroborar que el modelo resocializador del delincuente se encuentra actualmente en crisis o retirada, siendo superado por un modelo de respuesta a la delincuencia que se centra en la retribución del delito cometido y en el control del riesgo. Con carácter previo al análisis de la ejecución de las penas en España, entendemos imprescindible dedicar tres capítulos a definir el contenido de la reinserción social, analizar los orígenes de la prisión y del sistema penitenciario actual y describir los distintos medios y órganos con los que cuenta la Administración penitenciaria para implementar su modelo resocializador del delincuente. Una vez situado al lector en el sistema penitenciario español, analizamos las principales actuaciones que se producen en el momento del ingreso en prisión, deteniéndonos muy especialmente en la forma que se realiza la separación interior del interno. Valoramos si el procedimiento que se sigue en la práctica se adecua a la norma o, en realidad, no se consigue evitar el contagio criminógeno que se produce en prisión y que tan gravemente afecta a la reinserción social. Asimismo entendemos conveniente detenernos en las estrategias y herramientas que se utilizan para evitar los suicidios y el tratamiento que se otorga a determinados presos peligrosos. Desde que se produce el ingreso en prisión, la Administración penitenciaria tiene un plazo máximo de seis meses para clasificar al condenado en uno de los grados previstos por la normativa penitenciaria. Sin duda, se trata de una de las actividades más importantes y centrales del modelo resocializador, ya que, pretende detectar las carencias y déficits del condenado y proponer el correspondiente programa individualizado de tratamiento. Analizamos los rasgos del actual sistema de individualización científica, valorando cómo le han afectado las graves mutilaciones que viene sufriendo desde el año 2003. El modelo resocializador se centra o fundamenta en el tratamiento penitenciario del penado, cuyo objeto es dotarle de una socialización de reemplazo que le capacite formativa y profesionalmente para su posterior regreso a la vida en libertad. Analizamos los distintos programas de tratamiento existentes, los medios con los que cuenta la Administración para llevarlos a cabo y la participación del condenado en los mismos. Junto al tratamiento penitenciario, destaca el régimen penitenciario, el cual persigue asegurar una adecuada y pacífica convivencia en la prisión. El modelo resocializador defiende que el régimen debe estar al servicio del tratamiento y que, en caso de confrontación entre ambos, siempre deben primar los intereses de este último. Nos cuestionamos si, en la práctica, dicha preferencia por el tratamiento se produce o si la Administración sigue dando mayor importancia al orden, la seguridad y la disciplina. Analizamos los deberes de los internos y el régimen disciplinario, deteniéndonos, tanto en las infracciones, como en las sanciones previstas por al acervo jurídico penitenciario. Obviamente, también estudiamos los derechos de los internos y la forma preservarlos, haciendo especial hincapié en la figura del juez de vigilancia penitenciaria como garante de los mismos.
