On first leaf of a bifolium. In good condition, lightly aged. The reci…pient is not named. Addressed to 'Dear Madam' and signed 'Margaret Froude'. She cannot alter the opinion that she expressed to 'Mr Longman' (the London publisher). She considers it 'unjust to an author to quote passages without their context which, when standing alone are unworthy of his other writings'. The writings of 'Mr. Carlyle' are 'full of beautiful passages relative to your subject', and she hopes it will be easy for the recipient to find 'others to take the place of the two to which I take exception'.

Sir Henry James Sumner Maine 1822-1888, was a British Whig comparative jurist and historian. He is famous for the thesis outlined in his book Ancient Law that law and society developed "from status to contract." According to the thesis, in the ancient world individuals were tightly bound by status to traditional groups, while in the modern one, in which individuals are viewed as autonomous agents, they are free to make contracts and form associations with whomever they choose. Because of this thesis, Maine can be seen as one of the forefathers of modern legal anthropology, legal history and sociology of law. Size is 177mm x 114mm. Condition is good. Light folding crease. Two corrections are made by Froude in ink, on pages 95: "feebly" for "fully" and on page 157, adding "And we never shall know which is true until we know what motion is". In a back and forth in letters (see Mulhauser, The Correspondence of Arthur Hugh Clough, v.1), Feb. 26, 1849, to Thomas Arnold, "I have not yet seen the said book -- the Nemesis of Faith."; Feb. 28, 1849, Froude to Clough, "If I knew how to send you a copy I would. If you buy it, please remember that I have made an unfortunate omission in a sentence.You will find it about half way through, and supply at the tail.'and we never shall know which is true till we know what motion is'. In the second edition, also 1849, both mistakes were corrected.

James Anthony Froude (1818-1894) was a prominent 19th century English historian, novelist, biographer and editor. His works included the 12 volume History of England from the Fall of Wolsey to the Defeat of the Spanish Armada and several books on the life of Thomas Carlyle. Anne Charlotte Lynch Botta (1815-1891) was an American writer and socialite who hosted a literary salon in New York entertaining such writers as Poe, Emerson, Trollope, Thackeray, etc. Froude was in the United States on a lecture tour in 1872 which may help date the above letter. A folded sheet of 8" x 10" ruled paper with manuscript on three pages. Condition: Mailing fold lines, short edge separations reinforced with archival tissue/tape, mounting remnants on blank last page. Generally good condition. Signed by Author(s).
