Ob elektronische Wahlen rechtlich - also vor allem verfassungsrechtlich - überhaupt zulässig sind, ist jedoch nicht hinreichend geklärt. Der Autor untersucht daher die Frage, inwieweit die Einführung elektronischer Wahlen in ihren verschiedenen Varianten in der Bundesrepublik auf verfassungsrechtliche Hindernisse stà Ãt, die vor allem aus den Wahlrechtsgrundsätzen des Art. 38 Abs. 1 GG und ihrer gängigen Interpretation resultieren.
