Aus der Bibliothek von Prof. Wolfgang Haase, langjährigem Herausgeber der ANRW und des International Journal of the Classical Tradition (IJCT). - Altersbedingt vergilbt, sonst gutes Exemplar. - VORWORT Als der Verfasser im Jahre 1952 an die Sammlung der Fragmente des solonischen Gesetzeswerkes ging, stand er angesichts der Tatsache, daß sich unter den als solonisch angeführten Gesetzen viele Stücke fanden, die mit Sicherheit nicht solonisch sein konnten, vor der Frage, was denn bei einer derartigen Verfälschung der Überlieferung überhaupt noch als echt gelten könne und welche Kriterien es gebe, um Echtes von Unechtem unterscheiden zu können. In dieser Lage schien nur noch folgendes Verfahren einigen Erfolg zu versprechen: Es war einmal die Überlieferungsgeschichte der solonischen Gesetze zu klären, um allgemein sagen zu können, bei welchen Autoren eine zuverlässige Überlieferung zu erwarten ist. Des weiteren hatte sich der Verfasser mit der Entwicklungsgeschichte des athenischen Rechts zu beschäftigen, um eine Vorstellung davon zu gewinnen, was auf dem Gebiet des Rechts für die solonische Zeit vorausgesetzt werden kann. Nachdem die Überlieferungsgeschichte bereits veröffentlicht ist, sollen jetzt endlich, um auch die juristischen Kriterien zugänglich zu machen, die z. T. über ein Jahrzehnt alten Untersuchungen zur Geschichte des athenischen Strafrechts vorgelegt werden. Wie für das frühe römische Recht, so ist auch für das griechische Recht die Unterscheidung von Strafrecht und Privatrecht mit all ihren Konsequenzen für die Terminologie unbrauchbar, da zum Privatrecht auch der größte Teil dessen, was wir Strafrecht nennen, gehört. Es wird daher im Anschluß an Kunkels Untersuchungen zur Entwicklung des römischen Kriminal verfahrens in vorsullani- sdier Zeit (1962) 136 f. folgende Terminologie gebraucht: Privatstrafrecht ist das Recht, das die Verfolgung von Unrechtstaten gegenüber einer Privatperson regelt, wobei gleichgültig ist, ob die Verfolgung nur von dem Verletzten selbst durch die Privat(straf)klage oder von jedermann auf dem Wege der sog. Popularklage in Gang gesetzt wird, öffentliches Straf recht ist das Recht, das die Verfolgung von Unrechtstaten gegen den Staat selbst regelt. Die Unterscheidung von Kläger und Ankläger, von Klage und Anklage, von Delikt und Straftat ist für unsere Belange unwesentlich. Zu danken hat der Verfasser den Herren Prof. Dr. Kaser, Pringsheim und Berneker für Hilfe und Ermutigung und der Deutschen Forschungsgemeinschaft für die Gewährung eines Druckkostenzuschusses. Vor allem aber dankt der Verfasser Herrn Prof. Dr. Hans Julius Wolff.
