Über Anträge auf Naturalrestitution entscheidet die beim Allgemeinen Entschädigungsfonds für Opfer des Nationalsozialismus in Wien eingerichtete dreiköpfige Schiedsinstanz für Naturalrestitution. Die Anträge betreffen zumeist Liegenschaften, die in den Jahren 1938 bis 1945 entzogen worden waren, zum Stichtag des Abkommens am 17. Jänner 2001 im öffentlichen Eigentum standen und in vielen Fällen nach 1945 bereits Gegenstand von Rückstellungsverfahren gewesen sind.Seit 2003 hat die Schiedsinstanz zahlreiche Anträge geprüft und in einigen Entscheidungen die Restitution von Liegenschaften an die RechtsnachfolgerInnen der einstigen EigentümerInnen empfohlen. Dabei hat sie auf Basis des Entschädigungsfondsgesetzes eine differenzierte, einzelfallbezogene Spruchpraxis entwickelt.Band 8 enthält weitere Entscheidungen der Schiedsinstanz jeweils im deutschen Original und in englischer Übersetzung.The series 'Decisions of the Arbitration Panel for In Rem Restitution' documents a fundamental part of Austria,s most recent compensation measures dealing with the consequences of the National Socialist era. The Washington Agreement of 2001, which provided for in rem restitution of property seized during the National Socialist era that is now publicly-owned, forms the basis for these measures. The Arbitration Panel for In Rem Restitution, a three-person committee established with the General Settlement Fund for Victims of National Socialism in Vienna, decides on applications for restitution. For the most part, the applications concern real estate that was confiscated between 1938 and 1945, was publicly-owned on the Agreement cut off day, 17 January 2001, and in many cases had already been the subject of restitution proceedings after 1945.Since 2003, the Arbitration Panel has examined a great number of applications and has so far recommended the restitution of property to the legal successors of the former owners in some decisions. In the course of these decisions based on the General Settlement Fund Law, the Arbitration Panel has developed a complex case law.Volume 8 contains further decisions of the Arbitration Panel, each in the German original and with an English translation.
