Paperback. Condition: New. Print on Demand. This book examines the intricacies of devising land from the origination of devising practices through the passing of the Statute of Wills in the 16th century. Prior to the writing of this work, there was much confusion over what post-mortem conveyance of land was permissible. Anglo-Saxon wills granted the head of the household nearly complete power of disposal over land assets; however, with the introduction of feudalism, such power was significantly curtailed. The author details how the passing of mortmain and other statutes along with the emergence of ecclesiastical legal doctrines aimed to restore balance to devising customs. The author concludes by arguing that the book's subject has had a profound impact on the development of English law and could be of great interest to anyone seeking to better understand the history and complexities of devising land. This book is a reproduction of an important historical work, digitally reconstructed using state-of-the-art technology to preserve the original format. In rare cases, an imperfection in the original, such as a blemish or missing page, may be replicated in the book. print-on-demand item.…

"There is no learning in our law relating to real property more necessary to be known than that which respects the framing of a Devise, and the accidents that belong to it in its ambulatory state before its consummation by the death of the Devisor, and yet it has never been collected into any regular chain of connection." - To The Reader. Hardcover. Condition: Good. Hardcover. Full leather, with raised cords, maroon title label on the spine. Hinges cracked but cords strong. Leather is rubbed and scuffed. Text block tight. Title page dated 1792. Unpaginated, about 400 pages. Pages mildly toned from age and with some minor foxing. Front endpaper detached but set in place. On the inside front cover, early ownership name Robert Ware Peacock, Attorney at Law, Stephensburg (something illegible beneath). On the title page, handwritten note, 'Bot of Robert Ware Peacock 1795 by (illegible) 1800.' On rear free endpaper, the signature 'Robert Ware Peacock, attorney at Law, Winchester.'On the cover of the book, signed on the leather, is the name 'J Marshall Jr.' As with all things Virginia, there appear to be connections to everyone and everything. Peacock was indeed a lawyer, who seems to have set up in several different towns, ultimately ending up in Washington during the Jefferson administration. In the early 1800's he was indicted for forging foreign bills of exchange and was sentenced to 5 years in prison. The Jefferson papers include letters from both Peacock and his wife entreating a pardon. Peacock somehow escaped from prison and fled to England. As for the J. Marshall Jr signature on the front cover, it may belong to the son of justice John Marshall, or it might be another of the many Marshalls in Virginia at that time.
