(Freiburger rechtsgeschichtliche Abhandlungen, n.F., Band 26). - Als im Jahre 1959 die Autostrada del Sole auf der Strecke von Neapel nach Salerno erbaut wurde, stieß man unweit von Pompeji auf die Reste eines antiken Hauses, welches beim Vesuvausbruc…h von 79 n. Chr. verschüttet worden war. Bei den Grabungen fand man einen Weidenkorb mit einer Vielzahl römischer Urkunden auf kleinen Holztäfelchen (tabulae ceratae), die eine Schlammschicht auf wundersame Weise vor der Zerstörung bewahrt hatte. Der Inhalt der Urkunden eröffnet einen reichen Einblick in die Aktivitäten des Bankhauses der Sulpicii mit Sitz in Puteoli, das von Freigelassenen geführt wurde. Gegenstand der Untersuchungen ist eine bestimmte Gruppe von Urkunden, die jeweils mit 'tabellae', gefolgt von einem Namen im Genitiv, überschrieben sind (tabellae-Urkunden) und in ähnlicher Form auch aus Herkulaneum bekannt sind. Für diese Urkunden wird eine neue Deutung entwickelt, wonach es sich um eine Art von Kontoauszügen handelte, die der Dokumentation von Zahlungen im Dreipersonenverhältnis dienten. Insbesondere ging es um Zahlungen der Bank für Rechnung ihrer Kunden. Die Bestellung von Bürgschaften zeigt,daß hierbei Darlehensforderungen in Form von nomina arcaria gegen Dritte begründet wurden. Besonders rätselhaft ist das Schweigen der Urkunden über Rückzahlungszeitpunkt und Zinsen. Die Verwendung der Buchungskürzel Exp. und Acp. erfordert eine Analyse der römischen Buchführung. Dabei erweisen sich die Urkunden als Auszüge aus dem codex rationum der Bank. Ein abschließender Vergleich mit dem Formular der Bankdiagraphe aus den gräko-ägyptischen Papyri bringt neue Erkenntnisse zur Frage des bargeldlosen Zahlungsverkehrs und beweist den internationalen Charakter des antiken Bankwesens. Sono inoltre presenti alcune interessanti annotazione manoscritte di mano coeva. Non comune edizione di quest'opera, la più celebre del napoletano Matteo d'Afflitto, che ebbe grande diffusione diffusa, molte ristampe, fino al '700 e che non si sa esattamente in che anno vide la luce in originale (1499? 1509?). Book.

Capilettera, testatine e finalini calcografici. L'ultima parte del volume, con carte prive di numerazione, contiene "Historia utriusque belli Dacici a Traiano Caesare Gesti, ex simulachris quae in eiusdem columna Romae visuntur collecta" dello storico domenicano spagnolo Alfonso Chacon (Baeza, 1540 circa ? Roma, 1599). Seconda edizione di una dettagliata opera dell'archeologo romano di origini marchigiane Raffaele Fabretti (Urbino, 3 luglio 1620 ? Roma, 7 gennaio 1700), già data alle stampe nel 1683 a Roma per i tipi del Tinassi. Il Fabretti fu soprintendente agli scavi delle catacombe e dell'Agro Romano intorno all'Appia Antica, e tra gli ispiratori dell'Accademia dell'Arcadia. "Il Fabretti pubblicò poi un'opera sulla colonna Traiana, dove, per mezzo di iscrizioni e medaglie, tessé la storia della prima e seconda guerra dacica di Traiano, e dove trattò anche della Tabula Iliaca Capitolina, conservata nei Musei Capitolini di Roma (di cui il Fabretti fu il primo ad occuparsi, aggiungendo il disegno del rilievo in una tavola fuori testo), e degli emissari del lago del Fucino: "De Columna Traiani Syntagma, accesserunt explicatio veteris tabellae anagliphae Homeri Iliadem, atque ex Stesichoro Arctino et Lesche Ilii excidium continentis, et emissarii lacus Fucini descriptio" (Romae 1683, e poi 1690). Alla p. [421] è inserito un opuscolo non paginato, contenente la Historia utriusque belli Dacici. di Alfonso Chacon. L'opera contesta parecchi punti della "Colonna Traiana." pubblicata a Roma nel 1671 con i commenti di Giovanni Pietro Bellori alle incisioni di Pietro Santi Bartoli. In essa il Fabretti fece largo uso del metodo comparativo per interpretare e porre in luce le figure poco caratterizzate dei bassorilievi" (Massimo Ceresa in DBI, vol.XLIII). > Rossetti, 4798. Dabei bedienten sie sich nicht selten der Hilfe übernatürlicher Mächte und magischer Instrumente. Zu diesen Hilfsmitteln gehörten die Fluchtafeln, die sog. defixionum tabellae. Die kleinen, vorwiegend aus Blei bestehenden Lamellentäfelchen, die chthonische Götter in den Dienst zwingen und Konkurrenten verfluchen sollten, haben von jeher bei Altertumswissenschaftlern Aufmerksamkeit erregt. Inzwischen liegen rund 1500 Exemplare vor, die in einem Zeitraum von ungefähr 1000 Jahren, nämlich vom 5. Jahrhundert v. Chr. bis in das 6. Jahrhundert n. Chr., an verschiedenen Orten des griechisch-römischen Siedlungsgebietes gefunden worden sind. Vor allem um die Wende vom 19. zum 20. Jahrhundert wurde der Hauptteil der Tafeln studiert und veröffentlicht. Im Folgenden soll zunächst versucht werden, antike Magie- und Religionsvorstellungen voneinander abzugrenzen, um eine eventuelle Zuordnung der Defixionen zu einem dieser Bereiche zu erleichtern, bevor Aufbau, Struktur und grundlegende inhaltliche Funktionen der Fluchtafeln untersucht werden, und der Versuch unternommen wird, ihre Verflechtung in ein rituelles Kommunikationsmuster zu erklären. Darauf aufbauend sollen einzelne Fluchbeispiele die gewonnenen Erkenntnisse verdeutlichen. In einem letzten Teil wird versucht, die Frage zu beantworten, ob die Fluchtafeln als Phänomene ritueller Wirklichkeit auch tatsächliche Wirkung zeigten.
