Guardianship: The Court of Last Resort for the Elderly and Disabled

"Here at last is a book pulling together the insightful, data-packed and carefully crafted articles on guardianship… This compilation…traces with compelling clarity the strengths and weaknesses of the nation's system of surrogate decision-making. It shows a patchwork of uneven law, practices and resources. It shows a glaring lack of procedural due process, sporadic judicial review, courts operating with limited resources, insufficient use of alternatives less restrictive than plenary guardianship, and the crying need for guardianship services for the unbefriended elderly… All of the pivotal questions of procedural safeguards, functional assessments of capacity, limited guardianship orders, and accountability are etched in striking detail and useful statistics." ― BIFOCAL
