The following translation of our General Terms & Conditions is for informational purposes only and is made available to our international customers without commitment. In the case of any misunderstanding, the wording of the original German text of our General Terms & Conditions is legally binding.

General Terms & Conditions for orders placed with
Georg Schneebeli :: Rare Books & Prints
via AbeBooks Europe GmbH

1. Scope
The General Terms and Conditions (hereinafter referred to as ‘GTC’) apply exclusively to legal transactions concluded via the various websites and services of AbeBooks (hereinafter referred to as ‘AbeBooks’ or ‘online shop’). They are part of all contracts between orderers (hereinafter referred to as the ‘customer’) and Georg Schneebeli :: Rare Books & Prints, Kirchgasse 22, 8001 Zurich, Switzerland (hereinafter referred to as ‘Georg Schneebeli’, ‘we’ or ‘us’). Any conditions of the customer that conflict with or differ from these GTC are binding only if they have been agreed in writing by Georg Schneebeli.

Georg Schneebeli is subject to the terms and conditions of AbeBooks, which the customer has accepted by logging into his personal customer area.

We conclude contracts exclusively in German. In the event of translations, the German version of the contract shall prevail.

Georg Schneebeli reserves the right to amend the GTC. The version of the GTC that is valid on the date of the order or on the date the contract is concluded will always apply. The current GTC can be viewed and downloaded at any time at the AbeBooks homepage of Georg Schneebeli.

2. Offering and services
Georg Schneebeli’s offer includes unique antiquarian items that can be neither replaced nor altered.

We reserve the right to amend, present differently, supplement or delete any information that we provide through our websites, online marketplaces, social media channels, catalogues and other advertising media, etc.(hereinafter referred to as media channels). We also reserve the right to suspend publication temporarily or permanently without prior notice.

The presentation of the offer (hereinafter referred to as ‘objects’) in the online shop of AbeBooks does not constitute a binding offer of a contract. When placing an order, the customer makes a binding offer to purchase. We reserve the right to decide whether to accept the order.

Receipt of an order is confirmed by an email to the customer (order confirmation). This confirmation of receipt does not yet constitute a binding acceptance of the order. A contract of sale is not concluded until the order is confirmed in writing (order acceptance).

The customer will be informed immediately in writing if an order cannot be accepted.

3. Copyright and right of use
All the content (photos, texts, graphics, etc.) published by Georg Schneebeli is protected by copyright and/or trademark rights. It is not part of the offer.

4. Prices
All prices stated in the online shop of AbeBooks are net prices.

In addition to the net price, the cost of delivery and, if applicable, insurance and packaging will be charged. These costs can be seen in the order acceptance. The customer is granted a cooling off period of four (4) days in which this offer can be accepted or cancelled.

We reserve the right to change the prices of the objects offered at any time. The price agreed at the time of the order is decisive in conclusion of the contract of sale.

In the case of international deliveries, import duties, country-specific taxes and other import charges may apply. These duties, taxes and charges are not included in the sale price and responsibility for payment of these costs lies with the customer.

5. Payment terms
We send objects against the following methods of payment: credit card, PayPal and payment in advance.

For payment by credit card or other immediate methods of payment, the customer’s account is debited when the order acceptance is sent. The order will be sent immediately on receipt of payment.

For payment in advance, the customer will receive an invoice from us. The deadline for payment is seven (7) days from the invoice date. We will send the order immediately on receipt of the full invoice amount in our bank account.

For payment by transfer from abroad, all bank charges and fees are borne by the customer.

If the customer withdraws from the order after payment has been received and before the order is sent, we will return the amount received by bank transfer. All bank charges and fees are borne by the customer.

6. Reservation of ownership
The ordered objects will remain the property of Georg Schneebeli until payment has been made in full.

7. Transfer of risk
On receipt of the full purchase amount by Georg Schneebeli, the risk, in particular the risk of accidental loss and accidental deterioration of the purchased object, will be transferred to the customer. The resulting costs are borne by the customer.

8. Delivery
Unless otherwise agreed, delivery will be made to the invoice address.

We send our parcels by Swiss Post. Deliveries to an address in Switzerland are made within two to 4 working days. In the case of international deliveries, the delivery time depends on the destination country and is approx. four to 30 working days.

Any agreed delivery deadline will be extended in the case of unforeseeable obstacles (e.g. customs clearance) that are unavoidable despite reasonable care.

The customer acknowledges that depending on the destination country, different customs regulations apply to the import of goods and that in specific cases the customer may be responsible for obtaining additional documents, customs clearance or collection of the delivery. We therefore recommend that customers contact the local customs office for authoritative information on the import of antiquarian objects.

9. Cancelling your contract and returns
All items offered for sale by Georg Schneebeli are subject to a right of return in accordance with the terms and conditions provided by AbeBooks.

10. Warranty and limitation of liability
The statutory regulations for second-hand goods at the place of delivery apply.

The objects we offer are unique due to their age and condition. They show signs of use and wear, which have already been appropriately factored into the sale price. Consequently, the objects on offer are sold - to the extent permitted - without any warranty.

Descriptions and images are provided for each object, based on the best of our knowledge and belief. Despite the utmost care and checks, descriptions may be incomplete or inaccurate, and/or images may not perfectly reflect the actual condition of the item. Therefore, descriptions and illustrations are not intended to constitute contractually binding characteristics or properties in the sense of a material defect, but are provided solely for the information of customers. The only express exceptions to this rule are warranty statements issued by us.

Prior to purchase, customers have the right to view and inspect any item at our premises.

Claims for compensation by the customer are excluded, unless they are based on our wilful intent or gross negligence. This does not apply in the case of injury to life, limb or health of the customer.

We would also like to make it clear that we accept no liability for any loss or damage, whether it be material or immaterial, that may be incurred as a result of or in connection with the use of the published information. This includes any issues that may arise from the use of the information, the misuse of the connection, or from technical faults.

11. Choice of law and place of jurisdiction, severability clause
The legal relationship between Georg Schneebeli and the customer is governed exclusively by Swiss substantive law, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). In addition, mandatory regulations of the law of the state in which the customer is ordinarily resident apply, if the customer concludes a contract of sale that can be regarded as unconnected with their professional or commercial activity.

In the event that any provision of these GTCs is deemed to be invalid, the parties nevertheless agree that the intentions expressed in that provision shall be enforced to the greatest extent possible and that the remaining provisions of these GTCs shall remain in full force and effect.

Any failure by Georg Schneebeli to exercise or enforce a right or a provision in these GTC does not constitute a waiver of this right or provision.

The following exclusive places of jurisdiction apply:

a) For legal action brought by consumers, their place of residence or Zurich is the place of jurisdiction.

b) In all other cases, Zurich is the exclusive place of jurisdiction.
