The first drug legislation in Canada was passed as the Opium Act in 1908. The law prohibited the importation, manufacture and sale of non-medicinal opium, and was intended to destroy and terminate the Chinese opium trade in Canada. In 1911, the prohibition was broadened to include the act of opium smoking, and in the following years amendments to the Opium Act broadened the scope of the law to increase penalties for convictions and expand police powers of search and seize. This 1919 amendment added coca leaves, cocaine, and related derivatives to the list of prohibited substances, and anyone convicted of importing or exporting the drugs without a license faced a fine of up to one thousand dollars, imprisonment of up to one year, or a combination of both. Opiated tonics, elixirs, and other drug concoctions, produced by the patent medicine industry for a predominantly white consumer audience, remained legal, and were regulated under separate legislation.
