Article III states that these judges "hold their office during good behavior," which means they have a lifetime appointment, except under very limited circumstances. Article III judges can be removed from office only through impeachment by the House of Representatives and conviction by the Senate. H.R. 146 would make available, in cases involving circuit or district judges, an alternative procedure by trial of and judgment upon the issue of good behavior before the special statutory court for which the bill provides. This bill would keep the House of Representatives as a buffer between the judge and the necessity for him to go to his defense in a civil action suit initiated by the Department of Justice, and would also provide a normal, workable method of getting rid of crooked judges, and would be a step in the direction of giving the judiciary greater control over judges. Hatton William Sumners (May 30, 1875 April 19, 1962) was a Democratic Congressman from the Dallas, Texas area, serving from 1913 to 1947. He rose to become Chairman of the powerful House Judiciary Committee. As a loyal Democrat, he supported much of President Franklin Roosevelt's New Deal legislation. He drew the line at Roosevelt's plan to expand the US Supreme Court, after the Court began to rule that key parts of the New Deal were unconstitutional. As Chairman of the Judiciary Committee, Sumners discreetly worked in opposition, and came out formally against the Court-packing plan.
