Het recht is er voor mensen. Het heeft tot doel het menselijk handelen zo
efficiënt en rechtvaardig mogelijk te reguleren en aldus mensen in staat te
stellen om hun belangen te behartigen en vorm te geven aan hun leven.
Dat geldt voor het nationale recht evenzeer als voor het internationale recht.
Steeds meer wordt de scheidslijn tussen nationaal en internationaal recht een permeabele wand en beïnvloeden de rechtsstelsels elkaar wederzijds.
Het internationale recht bepaalt daardoor in toenemende mate de rechten, plichten en bevoegdheden van individuele mensen. In deze oratie wordt ingegaan op de consequenties die dit kan hebben voor de mogelijkheden van mensen om vorm te geven aan hun leven: kan vanuit dit perspectief de internationalisering van ons recht worden gezien als een positieve dan wel een negatieve ontwikkeling ten opzichte van het nationale uitgangspunt?
- Peter Rijpkema is als hoogleraar Algemene rechtsleer verbonden aan de juridische faculteit van de Universiteit van Amsterdam.
