This book approaches mining law from a perspective of judicial interpretation, presenting an in-depth look at the body of case law that has developed out of mining controversies in the Western United States. The author examines statutes that Congress has passed to govern mining on the public lands, and discusses the way in which the courts have interpreted those statutes. The book also discusses the various kinds of mining claims that can be located under federal law, including lode claims, placer claims, and mill sites, and the requirements that must be met in order to perfect a mining claim. The author discusses the rights of mining claimants, such as the right to extract minerals from the claim and the right to exclude others from the claim, and the various ways in which mining claims can be terminated.
