Arbitrators called upon to decide cases arising from international contracts; business people who make international contracts; officials faced with drafting or applying EC Directives and uniform laws affecting contracts; lawyers involved in international business; and teachers of contract law -- all these need to know the fundamental principles of contract law shared by the legal systems of the Member States of the EU, and to have them collected into a concise, comprehensive and workable statement of rules. The Principles of European Contract Law provides this statement. The Principles have been drawn up by an independent body of academic lawyers from each country of the European Union, under a project supported by the European Commission. The Principles are stated as articles, each accompanied by a commentary to explain its purpose, its operation and its relationship to the other articles. Each article also has a note providing a survey of the national laws on the topic. Part I of The Principles of European Contract Law deals with performance, and non-performance of contracts and the remedies available. Part II, which will be published in 1996, will cover formation, validity, interpretation and the authority of agents. In 1989 and again in 1994 the European Parliament called for the creation of the European Civil Code. These Principles may form its basis.
