Anhand des Maastricht-Urteils ist ein grundlegender Justizkonflikt zwischen Bundesverfassungsgericht und Europäischem Gerichtshof über die letztverantwortliche Kontrolle der Gemeinschaftskompetenzen festzustellen. Während das Bundesverfassungsgericht für sich in Anspruch nimmt, am Maßstab des deutschen Übertragungsaktes zu überprüfen, ob Gemeinschaftsrecht sich im Rahmen der eingeräumten Kompetenzen hält, besteht der Europäische Gerichtshof auf ein Auslegungs- und Verwerfungsmonopol in Bezug auf Gemeinschaftsrecht. Der Autor untersucht die Standpunkte beider Gerichte auf ihre innere Schlüssigkeit; er zeichnet die Begründungen nach, untersucht ihre Prämissen und stellt ihre Folgerichtigkeit fest. Der Anspruch des Bundesverfassungsgerichts auf Kompetenzkontrolle dient dem Schutz des Demokratieprinzips. Für den Europäischen Gerichtshof ist dagegen die Sicherung der Funktions- und Handlungsfähigkeit der Gemeinschaft der höchste Wert. Dieser Justizkonflikt besteht auf absehbare Zeit fort und kann allenfalls durch institutionelle Reformen gemildert werden.
