Anhand des Maastricht-Urteils ist ein grundlegender Justizkonflikt zwischen Bundesverfassungsgericht und Europ�ischem Gerichtshof �ber die letztverantwortliche Kontrolle der Gemeinschaftskompetenzen festzustellen. W�hrend das Bundesverfassungsgericht f�r sich in Anspruch nimmt, am Ma�stab des deutschen �bertragungsaktes zu �berpr�fen, ob Gemeinschaftsrecht sich im Rahmen der einger�umten Kompetenzen h�lt, besteht der Europ�ische Gerichtshof auf ein Auslegungs- und Verwerfungsmonopol in Bezug auf Gemeinschaftsrecht.
