Anhand des Maastricht-Urteils ist ein grundlegender Justizkonflikt zwischen Bundesverfassungsgericht und Europ�ischem Gerichtshof �ber die letztverantwortliche Kontrolle der Gemeinschaftskompetenzen festzustellen. W�hrend das Bundesverfassungsgericht f�r sich in Anspruch nimmt, am Ma�stab des deutschen �bertragungsaktes zu �berpr�fen, ob Gemeinschaftsrecht sich im Rahmen der einger�umten Kompetenzen h�lt, besteht der Europ�ische Gerichtshof auf ein Auslegungs- und Verwerfungsmonopol in Bezug auf Gemeinschaftsrecht. Der Autor untersucht die Standpunkte beider Gerichte auf ihre innere Schl�ssigkeit; er zeichnet die Begr�ndungen nach, untersucht ihre Pr�missen und stellt ihre Folgerichtigkeit fest. Der Anspruch des Bundesverfassungsgerichts auf Kompetenzkontrolle dient dem Schutz des Demokratieprinzips. F�r den Europ�ischen Gerichtshof ist dagegen die Sicherung der Funktions- und Handlungsf�higkeit der Gemeinschaft der h�chste Wert. Dieser Justizkonflikt besteht auf absehbare Zeit fort und kann allenfalls durch institutionelle Reformen gemildert werden.
