Today's right-wing populist movements combine elements compatible with democracy with others that are illiberal and anti-pluralist. This ra…ises the question of whether the legal strategies for protecting democracy devised in 1949 remain promising today. It is a matter of contention how divergent understandings of democracy influence these protective concepts; in this context, a distinction must be made between their legitimacy and their effectiveness. Furthermore, political exclusion must be precisely defined within the framework of the rule of law if the protection of democracy is not to inadvertently foster democratic erosion.; Die Erfolge der AfD haben die Wehrhafte Demokratie wieder ins Zentrum der Debatte geführt. Diese war eine Reaktion auf die Legalitätstaktik einer antidemokratischen Volksbewegung, die den bereits zuvor autoritär deformierten demokratischen Verfassungsstaat nach der Machtübernahme in atemberaubendem Tempo demontierte. Die Rechtspopulismen von heute verknüpfen demokratiekompatible (Mehrheitsregel, Volkssouveränität) mit antiliberalen und antipluralistischen Elementen. Dies macht sie nicht weniger gefährlich, wirft aber die Frage auf, ob die Demokratieschutzrezepte von 1949 auch heute rechtspolitisch angemessen und erfolgversprechend sein können. Die Analysen zeigen kontrovers auf, dass divergierende Demokratieverständnisse, wie sie schon die Weimarer Staatsrechtslehre prägten, die Bewertung von Schutzkonzepten beeinflussen. Dabei ist zwischen der Legitimität von Schutzvorkehrungen und ihrer Effektivität zu unterscheiden. Mechanismen politischer Exklusion müssen zudem rechtsstaatlich präzise definiert und eng umrissen sein, soll gutgemeinter Demokratieschutz nicht Demokratieerosion begünstigen.
