De verhoudingen tussen Kerk en Staat hebben tussen de 15de en 18de eeuw een fundamentele bijdrage geleverd aan de ontwikkeling van subjectieve natuurlijke rechten (zgn. gron…drechten of mensenrechten), en van de notie van constitutionele normen. Toch wordt deze periode traditioneel beschouwd als het hoogtepunt van het vorstelijk absolutisme, waarin geen respect bestond voor grondrechten van de onderdanen. Maar precies in het als absolutistisch te kwalificeren proces waarin de Staat zich geleidelijk opwierp als enige publiekrechtelijke macht, ten koste van o.a. de Kerk, werden door juristen en kerkjuristen argumenten gebruikt die wijzen op de institutionele bescherming van grondrechten van de onderdanen, zoals het recht op een eerlijk proces of het recht op vreedzaam bezit. Deze argumenten werden op de eerste plaats ingeroepen tegenover de kerkelijke overheid, maar meer en meer ook tegenover het staatsgezag zelf. Het is daarbij opmerkelijk dat deze argumenten afkomstig waren uit het Romeins recht en uit het middeleeuws kerkelijk recht. Het kerkelijk recht functioneerde met andere woorden als het model voor de Westerse Staat, zowel in de centraliserende-absolutistische dynamiek als in de bescherming van grondrechten van onderdanen. Dit onderzoek reconstrueert de ontwikkeling van twee rechtsfiguren die de verhoudingen tussen Kerk en Staat tussen de 15de en de 18de eeuw hebben bepaald, en waarvan nog een vage echo is terug te vinden in de Belgische grondwet van 1831 (art. 16). Deze rechtsfiguren vormen de kern van het vroegmoderne juridische stelsel van verhoudingen tussen Kerk en Staat, omdat ze de Staat toelieten om waar nodig de kerkelijke wetgeving en rechtspraak te controleren. In de rechtsleer werden deze rechtsfiguren op relatief eenvormige wijze verantwoord: de Staat heeft de plicht om de rechten van de onderdanen te beschermen tegenover geweld van allerlei aard, ook indien dat 'geweld' afkomstig is van de kerkelijke overheid. Hieruit groeide het idee dat deze rechten ook konden ingeroepen worden tegenover geweld dat van het staatsgezag uitging. De resultaten van dit onderzoek werden geanalyseerd vanuit een historisch en rechtstheoretisch perspectief. Om na te gaan of, en hoe, de vroegmoderne verhoudingen tussen Kerk en Staat hebben bijgedragen tot de ontwikkeling van subjectieve natuurlijke rechten of constitutionele normen, is het nodig om te weten wat 'subjectieve natuurlijke rechten' of 'constitutionele normen' zijn.
