Im geltenden Recht werden die hierdurch aufgeworfenen datenschutz- und vertragsrechtlichen Fragen jedoch nur teilweise ausdrücklich adressiert. Jonas Baumann untersucht die Grundlagen datenfinanzierter Geschäftsmodelle mit Blick auf die Wechselwirkungen zwischen der datenschutzrechtlichen Einwilligung und der Vertragsbeziehung zwischen Nutzer und Anbieter, einschließlich der vertragsrechtlichen Folgen des Widerrufs der datenschutzrechtlichen Einwilligung im Hinblick auf Vertragsbindung und Vertragsäquivalenz. Hierbei werden die freiwilligkeitsbeeinflussenden Umstände in derartigen Geschäftsmodellen systematisiert, was die Entwicklung eines Modells zur Beurteilung der Freiwilligkeit eröffnet. Darüber hinaus werden Maßnahmen zur Förderung der informationellen Freiheit erarbeitet und verschiedene Mechanismen zur Erhaltung der Vertragsäquivalenz analysiert.
