Mit etwa zehntausend Einwohnern war sie die wichtigste Stadt zwischen Erfurt und Breslau und ebenso groß wie Frankfurt am Main. Eine flori…erende Tuchfabrikation mit einem überregionalen Absatzmarkt führte zu einer außerordentlichen ökonomischen und sozialen Differenzierung, wie sie sonst nur in der Handelsmetropole Augsburg anzutreffen war. Görlitz war damit in mancher Hinsicht den großen Reichsstädten ebenbürtig, auch wenn es dem böhmischen König untertänig und nicht reichsunmittelbar war. Gleichwohl verfügte die Stadt über ein hohes Maß an politischer Unabhängigkeit und ist daher zu den sogenannten »Autonomiestädten« zu rechnen. Dies drückte sich nicht zuletzt in einer eigenständigen Gerichtsbarkeit aus. Sie ist der zentrale Gegenstand des Buches. Erstmals wird untersucht, welche Zusammenhänge in einer »Autonomiestadt« zwischen der Stadtverfassung, dem Strafrecht und dem Umgang mit abweichendem Verhalten bestanden. Dabei wird deutlich, daß Görlitz gegenüber den von der Historischen Kriminalitätsforschung bisher untersuchten Reichsstädten des Südens und Westens eine besondere innerstädtische Verfassung und zudem eine spezifische Rechtstradition aufwies mit spürbaren Folgen für das Verhältnis der Bürger zur städtischen Obrigkeit, aber auch für ihre alltäglichen Konflikte. In Städten wie Nürnberg, Köln oder Konstanz war eine flexible und am Konsens der Bürgerschaft orientierte Justizpraxis maßgeblich für die Wirkung von Strafrecht und Sozialer Kontrolle. Der Görlitzer Stadtrat hingegen, der seine Legitimation ausschließlich auf den König zurückführte und seine Herrschaft nicht auf den Konsens der zünftischen Bürgerschaft stütze, entwickelte kein solch flexibles, am Status der Delinquenten und an spezifischen Strafzwecken orientiertes Instrumentarium der Justiz. Vielmehr beließ er die archaischen und starren Normen des Sachsenrechts weitgehend unverändert. Dies führte zu einer geringeren Effizienz der Strafgerichtsbarkeit und zu einer unzureichenden Kontrolle alltäglicher Konflikte. Manches deutet darauf hin, daß fehlende politische Teilhabe, das Festhalten an alten Rechtstraditionen und der gewaltsame Austrag von Konflikten für den Nordosten des Reiches typisch waren.
