Genialer Jurist oder konsequenter Vollstrecker eines Systems, das er selbst mit geschaffen hat? Die Fragen zu seiner Person, sein Psychogramm, treten in diesem Bu…ch in den Hintergrund.Zu untersuchen galt: Was hat er in seiner Zeit auf dem Gebiet der Rechtswissenschaft vollbracht? Dabei zählen nur die vorgefundenen, objektiven Tatsachen für eine wissenschaftliche Betrachtungsweise. Auf subjektive Bewertungen wurde verzichtet. Freisler war u.a. an der Schaffung des nationalsozialistischen Strafrechts beteiligt. FuÃen seine Erkenntnisse und Ausführungen auf wissenschaftliche Grundlagen? Oder war er nur ein politisches Sprachrohr einer verbrecherischen Weltanschauung? Jede Ideologie benà tigt ihre philosophische Rechtfertigung. Auch das III. Reich. Neuhegelianer wie: Julius Binder, Karl Larenz u.a. versuchten mit Hilfe der hegelschen Philosophie die Ideologie der Nationalsozialisten auf eine philosophische Grundlage zu stellen. Im Ergebnis scheiterten, durch den MiÃbrauch der Philosophie Hegels, alle diese Versuche. Durch die umfassende Interpretation der hegelschen Rechtsphilosophie und den anschlieÃenden Vergleich mit den NS-Philosophen wird dies deutlich. Die hier dargestellten "Neuhegelianer" waren Parteiideologen und damit im hegelschen Sinne "Schein-Philosophen". Dieses zeigt auch der weitere Vergleich der NS-Philosophen mit dem "Nicht-Hegelianer" Freisler. Sie sprachen die gleichen Worte wie Freisler. Sie rissen Hegel aus dem Zusammenhang und verfälschten seine Philosophie. Ihre Intention, d.h. warum sie dieses taten, stand nicht zur Untersuchung an. Das "Wie" sie es taten, war wissenschaftlich aufzuarbeiten. Die Tatsache, dass Hegel miÃbraucht worden ist, führte nach dem 2. Weltkrieg bei einigen Wissenschaftlern zu der falschen Annahme: "Ohne Hegel kein Hitler!" Der Inhalt des Buches zeigt, dass dieser These die Grundlagen fehlen. Freisler steht lediglich als Beispiel für die einfluÃreichen Juristen, die es im III. Reich verstanden haben, ihre Fähigkeiten und beruflichen Stellungen für parteipolitische Zwecke und damit der Machterhaltung auszunutzen. Damit schlieÃt sich auch der Kreis der NS-Philosophen hin zu Freisler. Mit den Worten Hegels gesprochen war nicht nur der gesamte NS-Staat ein "Scheinstaat", sondern auch die "Neuhegelianer", waren "Schein-Philosophen".
