Dabei zeigt sich, dass die gesetzliche Regelung eine Sache ist, die tatsächliche Verfolgung aber eine ganz andere. Als exemplarisches Beispiel wird dargelegt, dass in der Schweiz vermutlich unverjährbare Verbrechen am Volk der Jenischen begangen wurden, die bis heute ungeahndet geblieben sind.

Schliesslich soll Rechtshilfe nicht aus der Strafgewalt ausgegrenzt werden und nicht als verwaltungsrechtlicher, sondern als strafrechtspflegerischer Akt gelten.
