A long letter discussing the life of her recently departed husband Sir Henry Maine. Edward John Phelps 1822-1900 was a lawyer and diplomat from Vermont. He is notable for his service as Envoy to Court of St. James's from 1885 to 1889. In addition, Phelps was a founder of the American Bar Association, and served as its president from 1880 to 1881. Sir Henry James Sumner Maine 1822-1888, was a British Whig comparative jurist and historian. He is famous for the thesis outlined in his book Ancient Law that law and society developed "from status to contract." According to the thesis, in the ancient world individuals were tightly bound by status to traditional groups, while in the modern one, in which individuals are viewed as autonomous agents, they are free to make contracts and form associations with whomever they choose. Because of this thesis, Maine can be seen as one of the forefathers of modern legal anthropology, legal history and sociology of law. Size is 202mm x 127mm. Condition is good. Light folding crease. Phelps writes on November 6 1888 - election day in the US. Although the notepaper is of the US Legation in London, Phelps has clearly arrived back in the States. He writes to Emma Pender, the wife of Sir John, a Scottish politician and pioneer in submarine communications cabling: Dear Lady Pender,I reached home safe and sound yesterday morning after a journey made very short by good company.I am full of pleasant memories of my visit at your charming house, made so happy by the kindness of time taken by yourself. I only regret that Mrs Phelps could not have shared it with me. We are "in the throes of expectations" in respect to the Presidential election, which I take to be a much more elevated condition than to be merely waiting for news.I hope you are well and favoured with brighter weather than prevails here. Always dear Lady PenderSincerely yours,E A Phelps Phelps, a Democrat at this time, would have been cheerleading for the incumbent President, Grover Cleveland, but he was defeated by Benjamin Harrison, the former Republican Senator from Indiana. .
