Bd. 2 mit Sachregister. - ?Das Archiv [.] setzt sich die Mittheilung von Abhandlungen über Rechtsmaterien aus dem Gebiete des Civil-, Prozess- und Criminalrechtes, innerhalb der Grenze des rein practischen und auf der Grundlage und in dem Rahmen wirklich verhandelter Rechtsfälle und deren Entscheidung durch deutsche Gerichtshöfe, zur hauptsächlichsten Aufgabe.? III, aus der ?Vorerinnerung?). -- Martin Schäffer (Giessen 1803-1861 Darmstadt), Oberappellationsrath und juristischer Schriftsteller. ?Im December 1835 wurde er als Rath an das Hofgericht in Giessen berufen, wo er gegen 25 Jahre (bis zu seiner im August 1860 erfolgten Beförderung zum Mitglied des Obertribunals in Darmstadt) thätig war. In der Zwischenzeit (um Weihnachten 1855) erhielt er von der Juristenfacultät der Giessener Hochschule in Anerkennung seiner wissenschaftlichen Leistungen das Diplom eines Doctor utriusque juris honoris causa, nachdem er drei Jahre früher (1852) im Verein mit Dr. E. Seitz und Dr. E. Hoffmann, zweien Mitgliedern des Darmstädter Hofgerichtes, das ?Archiv für praktische Rechtswissenschaft aus dem Gebiete des Civilrechts, des Civilprozesses und des Criminalrechts etc. etc.? gegründet hatte, dessen Redacteur und eifriger Mitarbeiter Schäffer wurde, und bis an sein Lebensende blieb. [.] Schäffer's litterarische Wirksamkeit erfuhr eine sachgemässe Steigerung, als er im März 1852, wie schon erwähnt, das ?Archiv für praktische Rechtswissenschaft? gründete, als dessen hauptsächlichste Aufgabe er in der Vorerinnerung (Band I, S. I-VIII, Darmstadt im März 1852) die Mittheilung bezeichnete von Abhandlungen über Rechtsmaterien des Civilprozess- und Strafrechts auf Grundlage wirklicher verhandelter Rechtsfälle nebst theoretischen Excursen gemeinrechtlichen Inhaltes. Das Archiv brachte daher neben Aufsätzen letzterer Kategorie hauptsächlich die Rechtsübung des Darmstädter Obertribunales zur Anschauung; galt indeß nicht allein im Großherzogthume, sondern auch in weiteren juristischen Kreisen als eine geschätzte Zeitschrift; denn Schäffer war als Redacteur unablässig bemüht, durch gediegene Mittheilungen seinem Journale eine geachtete Stellung zu verschaffen und zu erhalten.? Bezeichnung im Titel ?Grossherzoglich-Hessischer Oberappelations- und Cassationsgerichtsrath, Ritter des Verdienstordens Philipps des Grossmüthigen? : i.e. wohl: Wilhelm Müller (Hannover 1830-1915), Jurist. Sein rund 200-seitiger Traktat behandelt das spezifische Problem der Verjährung (lat.: Praescriptio) unter besonderer Berücksichtigung des Zivilrechts. ?Verjährung, im weiteren Sinn, ist dann vorhanden, wenn der Verlust der Freiheit zu handeln oder zu unterlassen bloss dadurch geschieht, dass man sich den Anmassungen eines Andern nicht widersetzt, oder dass man binnen einer Zeit von seinem Rechte keinen Gebrauch macht.?
