Schwinge (1903-1994) war seit 1931 Professor der Rechtwissenschaften und verfasste in der NS-Zeit den maßgeblichen Gestzeskommentar zum Militärstrafrecht. 1941 wurde er Staatsanwalt, später Militärrichter der Division 177 in Wien, wo er selbst in mindestens acht Fällen Todesurteile fällte. Nach dem Krieg konnte er trotz tiefbrauner Vergangenheit seine juristische Karriere nahtlos fortsetzen und war 20 Jahre lang Dekan der juristischen Fakultät der Universität Marburg. Als Mitverfasser eines 1977 veröffentlichten und lange als Standardwerk geltenden Werkes zur NS-Militärjustiz behauptete er die Militärgerichte seien vom NS-Regime weitgehend unabhängig gewesen.
