Paperback. Condition: New. Print on Demand. This book provides a comprehensive examination of the concept of moral delay, or mora, in ancient Roman law. The author traces the development of the doctrine of mora from its origins in the Roman Republic to its codification in the Justinian Code. The author argues that the classical Roman understanding of mora was not based on the notion of fault, but rather on the idea that a debtor's unjustified delay in fulfilling an obligation caused harm to the creditor. This harm was compensated for by the payment of interest or, in the case of non-pecuniary obligations, by the payment of damages. The book also explores the relationship between mora and other concepts in Roman law, such as culpa (fault) and periculum (risk). The author argues that mora is distinct from both of these concepts, and that it can arise even in cases where there is no fault on the part of the debtor. This book is a valuable resource for scholars of Roman law and legal history. It provides a comprehensive overview of the doctrine of mora and its development over time. The author's insights into the nature of mora and its relationship to other legal concepts are sure to be of interest to anyone interested in the history of law. This book is a reproduction of an important historical work, digitally reconstructed using state-of-the-art technology to preserve the original format. In rare cases, an imperfection in the original, such as a blemish or missing page, may be replicated in the book. print-on-demand item.…
