A controversial work arguing against papal absolutism, instead advocating a form of Catholicism giving greater power to bishops than to the pope. This conception of Church authority formed the basis of the heresy known as Febronianism, which was popular in 18th-century Germany. Volumes published in 1763, 1770, and 1772, respectively. Text is in German. Included at the end of the third book is a defense of Febronianism against the criticism of Jesuit theologian Francesco Antonio Zaccaria.

Band 1 anfänglich ohne Bandindizierung (vgl. u.a. ZVDD). Letzterer erschien 1765 als überarbeitete Editio Altera, priore emendatior et multo auctior, und 1766 bereits als Editio Quinta (ibid.; s. ZVDD). - Die vorliegende Ausgabe unterscheidet sich zumindest satztechnisch wesentlich von der über 655-seitigen von 1763, indem 1765 die Schrift kleiner und der Satzspiegel wesentlich grösser ist, was die Seitenzahl in etwa halbierte. Man kann wohl davon ausgehen, dass es sich hier um eine undeklarierte, vorwiegend wohl eher nur formale erste Revision handelt (so sind z.B. die Errata nach dem Index von 1763 nicht mehr vorhanden), die jedoch gänzlich neu gesetzt wurde. - ?Der ?Febronius?, in neuen Auflagen durch Ergänzungen und Streitschriften bis 1773 auf 5 Bände erweitert, ist unmittelbar aus der Diskussion um Artikel XIV der Kaiserlichen Wahlkapitulation von 1742 [.] entstanden und im Zusammenhang mit den Gravamina contra Curiam Romanam und dem Streit um die deutschen Konkordate zu verstehen. [.] Mit Hilfe der empirisch-historischen Methode [.] lehnte Hontheim eine monarchische Regierungsform der Kirche ab und reduzierte den päpstlichen Primat nach dem Leitbild der ersten acht nachchristlichen Jahrhunderte praktisch auf einen Ehrenvorrang. Eine mit der bischöflichen konkurrierende Jurisdiktion stehe dem Papst nicht zu, unfehlbar sei nur die Kirche und das allgemeine Konzil, das über dem Papst stehe. [.] Der ?Febronius? wurde 1764 indiziert [.]. Nach längerem hartnäckigem Leugnen [.] verstand sich Hontheim [.] 1778 zum förmlichen Widerruf, den er jedoch [.] weitgehend abschwächte. Febronius das hier vorliegende aufsehenerregende Werk, das eine weitgehende Reduktion päpstlicher Rechte zugunsten…des Episkopats und einer Wiedervereinigung im Glauben propagiert und damit den Febronianismus begründete. Der Text wurde bis 1773 auf insgesamt 5 Bände erweitert, allerdings bereits 1764 auf den Index gesetzt. Nach hartnäckigem Leugnen seiner Verfasserschaft verstand sich von Hontheim 1778 zum förmlichen Widerruf. Dennoch übte der Text einen nachhaltigen Einfluß auf die Kirchen- und Geistesgeschichte des 18. und 19. Jahrhunderts aus (vgl. LthK). Vorne mit handschriftlichen Einträgen von alter Hand in Tinte, sonst handelt es sich um ein gut erhaltenes Exemplar mit nur leichten Gebrauchsspuren.

Innen guter Zustand unter Berücksichtigung moderater Seitennachdunkelung und weniger kleiner Randläsionen. Mit Stempeln und Rückensignaturen einer aufgelösten Klosterbibliothek. --- "Das System der kirchlichen Verfassung, welches H. nun in seinen 9 Kapiteln entwickelt, ist im wesentlichen dasjenige der gallicanischen Schule, wie es namentlich Richer vorgetragen. Der Grundgedanke des Werkes ist die Leugnung der monarchischen Verfassung der katholischen Kirche: nach Febronius erhalten Papst und|Bischöfe ihre Gewalt von der Kirche, welche durch das Generalconcil vertreten wird, das über dem Papste steht. Er leugnet den Primat nicht, wol aber, daß derselbe nothwendig mit dem römischen Bischofsstuhl verbunden ist. Ohne Reception und Consens seitens der Kirche sind die Decrete des Papstes weder in Dingen der Disciplin, noch des Glaubens irreformabel; viele dem Papste jetzt zustehende Rechte, wie die Confirmation der Bischofswahlen, die Postulation, Consecration und Absetzung der Bischöfe, Errichtung neuer Bischofssitze, Canonisation u. s. f., sind zufällige, nicht inhärirende Rechte des Primates; angemaßte und falsche Rechte desselben aber seien z. B. die Infallibilität, die Gewalt in weltlichen Dingen, die mit den Bischöfen concurrirende Gerichtsbarkeit; den Bischöfen widerrechtlich entzogen seien die Reservation von Sünden, die Exemption gewisser Orden, die Verleihung von Präbenden und Dignitäten über den Kopf der Ordinarii, die Beschränkung der bischöflichen Wahlen, die Annaten, die Ausübung unmittelbarer Legislation in den Diöcesen, zahlreicher Dispensationen und die Appellationen von den Sprüchen des untern Richters. H. erklärt nun, die Kirche müsse in Hinsicht all' dieser Dinge in den Zustand der ersten Jahrhunderte zurückkehren, in die Zeit, ehe die pseudo-isidorischen Decretalen die gesammte Gesetzgebung derselben gefälscht und zu Gunsten Roms umgeworfen haben.
