Organisation der Gesundheitssysteme lag damals wie heute bei den einzelnen Gründungsstaaten der EWG bzw. heute bei den Mitgliedsstaaten der Europäischen Union (EU). Trotzdem und gerade wegen des Fortschreitens des europäischen Integrationsprozesses gewinnt die Gesundheitspolitik und das Sozialrecht immer mehr an Bedeutung. Zwischen der supranationalen Wirtschafts- und Währungspolitik und der Gesundheits- bzw. Sozialpolitik bestehen Interdependenzen. Die Krankenversicherung als Zweig des Gesundheitswesens wird immer mehr von den Regeln und den Urteilen des Europäischen Gerichtshofes (EuGH) beeinflusst. Das Gesundheitswesen ist in allen Mitgliedsstaaten der EU ein erheblicher Wirtschaftssektor mit enormen Beschäftigungszahlen und Finanzvolumen. Auch im Hinblick auf die demografische Entwicklung der europäischen Wirtschaftsländer wird ein leistungsfähiges Gesundheitssystem im europäischen Kontext zu einer noch größeren Gewichtung führen. Die Krankenversicherung ist Teil der Gesundheitspolitik und gliedert sich speziell in das Sozialrecht ein. Sozialrecht bezieht sich auf das Recht der sozialen Sicherheit und der Sozialhilfe. Beide werden als System des sozialen Schutzes bezeichnet und bestehen seit mehreren Jahrzehnten in allen europäischen Staaten. Es umfasst im Wesentlichen die Einrichtungen sozialer Vorsorge für die Risiken Krankheit und Mutterschaft, Alter und Invalidität, Arbeitsunfall und Berufskrankheiten, Arbeitslosigkeit, die Familienleistungen sowie die Sozialhilfe. Der Inbegriff dieser Einrichtungen bildet das Sozialrecht.
