L'autore analizza, con l'ausilio 'della storia, della filosofia, dela dottrina, della giurisprudenza' la seguente questione: 'se rinviato dalla Corte d'Assise un processo alla prossima sessione seguente per errore di verdetto in applicazione dell'art. 509 del Codice di procedura penale, il dibattito del nuovo giudizio debba essere soltanto limitato a quel capo di verdetto, in cui l'accusato è stato dichiarato colpevole del fatto principale, rimossa ogni discussione sulle circostanze aggravanti, che i primi giurati esclusero, ovvero se nel nuovo giudizio debba dedursi tutta intera la causa, e possano discutersi ex integro davanti al nuovo giurì tutti i capi della primitiva accusa' (dalla dedicatoria a Francesco Carrara).
