The student must weigh the social factors and must concentrate upon the functioning of the rule of law. This makes the moot court an excellent laboratory for the testing and comparison of the older theories that the law is deductive, formal and arbitrary with the newer theory that the judge exercises a directive force to make law conform with social needs.
