Professor nach Königsberg berufen, als Nachfolger von Eduard Kohlrausch. Es folgten nach dem Krieg Rufe nach Heidelberg (1920) und Bonn (1926). Sein Hauptanliegen als Strafrechtler sah er in einer Stärkung der Rechtssicherheit und im verstärkten Schutz des Angeklagten im Verfahren. Er war 1919/1920 Mitglied der Weimarer Nationalversammlung und wurde 1920 in den Reichstag gewählt (das Mandat legte er aber nach seinem Ruf an die Universität Heidelberg nieder). Wie z. B. seine Stellungnahmen zum berühmten Urteil im Magdeburger Beleidigungsprozeß zeigen, trat er für die Weimarer Republik ein und wandte sich gegen jede Form des Extremismus. So forderte er ein Verbot von KPD und NSDAP, trat aber auch für die Änderung des "destruktiven Misstrauensvotums" der Weimarer Reichsverfassung in ein "konstruktives Misstrauensvotum" nach preußischem Vorbild ein.…
