Dezember 1997 zum Rahmenübereinkommen der Vereinten Nationen über Klimaänderungen (Kyoto-Protokoll) zurückzuführen. In der Europäischen Gemeinschaft startete das Emissionshandelssystem zum 01. Januar 2005. Dahingehend hatten die Mitgliedstaaten sicherzustellen, dass bei Anlagen die entsprechenden emittierenden Tätigkeiten nur dann durchgeführt werden, wenn der Anlagenbetreiber über eine Genehmigung verfügt. Maßgeblich hierfür ist auf nationaler Ebene das Treibhausgas-Emissionshandelsgesetz (TEHG). Zweck dieses Gesetzes ist es, für Tätigkeiten, durch die in besonderem Maße Treibhausgase emittiert werden, die Grundlagen für den Handel mit Berechtigungen zur Emission von Treibhausgasen in einem gemeinschaftsweiten Emissionshandelssystem zu schaffen, um damit durch eine kosteneffiziente Verringerung von Treibhausgasen zum weltweiten Klimaschutz beizutragen. Die vorliegende Arbeit setzt sich mit der in 4 TEHG umgesetzten Emissionsgenehmigung auseinander. Konkret wird sich mit dem Regelungsinhalt des 4 TEHG, dem Rechtscharakter der Genehmigung und ihrer Funktion befasst sowie mit der geplanten Umsetzung im Umweltgesetzbuch (UGB).
