The Eureka Consolidated Mining Company, an underground, hard rock mining company operating about two miles from Eureka, Nevada, on Ruby Hill, brought a suit in ejectment against the Richmond Mining Company of Nevada to recover the possession of a valuable mining property. Stephen J. Field (1816-1899), one of the great justices of the nineteenth century, formerly the fifth Chief Justice of the Supreme Court of California, was in the midst of his lengthy tenure (1863-1897) as associate justice of the U.S. Supreme Court when he, the Hon. Lorenzo Sawyer, United States Circuit Judge of the 9th Circuit, and the Hon. E. W. Hillyer, United States District Judge for the District of Nevada, heard this case in San Francisco. The court's ruling on this complex and significant case involving mining law was appealed to the Supreme Court on a technicality. In 1881 Chief Justice Waite, after stating the case, delivered the opinion of the court: "Upon the facts set forth in the preceding statement we have no difficulty in reaching the conclusion that the judgment of the court below, sustaining the title of the Eureka company, was right." See U.S. Reports: Richmond Mining Co. v. Eureka Mining Co., 103 U.S. 839 (1881). Not in Paher.
