Er erà rtert ungeklärte Fragen im Zusammenhang mit der teilrechtsfähigen Wohnungseigentümergemeinschaft und versucht Là sungsansätze zu finden durch einen Vergleich mit der in vielen Punkten ähnlich strukturierten GbR und durch eine entsprechende Anwendung ihrer Grundsätze. In der Literatur wurde im Nachgang an die WEG-Novelle weithin bekräftigt, dass durch die Kodifizierung der Teilrechtsfähigkeit der Wohnungseigentümergemeinschaft das Wohnungseigentum einen "groÃen Schritt weg vom Immobiliareigentum hin zur gesellschaftsrechtlichen Beteiligung" gemacht habe. Sowohl bei der Wohnungseigentümergemeinschaft als auch bei der GbR blieben zahlreiche Fragen insbesondere zum Umfang der Teilrechtsfähigkeit offen. Dennoch entwickelten sich einige - in dieser Untersuchung näher beleuchtete - Aspekte durchaus gleichgerichtet bzw. lässt sich eine solche Gleichgerichtetheit bei genauerer Untersuchung teilweise feststellen. Ein wesentlicher Aspekt ist das Verwaltungsvermà gen. Ãber dieses kà nne als Teil des Gesamthandvermà gens nicht getrennt verfügt werden. Vor diesem Hintergrund und trotz der durch den Bundesgerichtshof vorgenommenen deutlichen Abgrenzung von Wohnungseigentümergemeinschaft und GbR nimmt die vorliegende Studie nunmehr die Situation zum Anlass, die dargestellten Auffassungen eingehend zu überprüfen und der Fragestellung nachzugehen, ob und inwieweit die für die GbR geltenden Grundsätze und Regelungen auf den trotz Novellierung noch ungeregelten Charakter der Wohnungseigentümergemeinschaft Anwendung finden kà nnen.
