Der Verfasser untersucht die Geltung/Nichtgeltung des Gesetzlichkeitsprinzips mit seinen fünf Ausprägungen (Rückwirkungsverbot, Analogieverbot, Bestimmtheitsgebot, Schriftlichkeitsgebot und Gesetzesrang der Strafnormen) im kanonischen Strafrecht der lateinischen Westkirche. Der Autor kommt zu dem Ergebnis, dass im kanonischen Strafrecht zufolge der Generalnorm des c. 1399 des CIC/1983 das Gesetzlichkeitsprinzip im Sinne des Artikels 7 Absatz 2 der Europäischen Menschenrechtskonvention sowie des Artikels 103 Absatz 1 des deutschen Grundgesetzes nicht gegeben ist. Trotz der Normierung des Analogieverbotes im c. 19 CIC/1983 wird dieses Verbot durch die Generalnorm wieder ausgehebelt. Die herrschende kanonistische Lehre, wonach c. 221 § 3 CIC/1983 das strafrechtliche Gesetzlichkeitsprinzip enthalte und dieses durch die Generalnorm lediglich durchbrochen werde, wird widerlegt. Die Studie hebt hervor, dass die Generalnorm mit dem Inhalt der cc. 221 § 3 und 1321 §§ 1 und 2 kompatibel ist. Die Durchbrechung des Gesetzlichkeitsprinzips im Sinne der Europäischen Menschenrechtskonvention und des deutschen Grundgesetzes wird durch die Generalnorm nicht bewirkt, weil der CIC/1983 das Gesetzlichkeitsprinzip im obigen Sinn nicht enthält. Lediglich die im c. 19 CIC/1983 ersichtliche Ausprägung des Legalitätsprinzips als Analogieverbot wird durch die Generalnorm obsolet. Denn diese hebelt durch die ermà glichte rückwirkende Strafbewehrung das Verbot der Analogie aus. Die zulässige strafrechtliche Rückwirkung - neben der Zurechnungs- und Schuldvermutung - erweist sich als eine Strafrechtsfigur, die in der europäischen Aufklärung und im 19. Jahrhundert von den maÃgebenden Rechtsgelehrten und Philosophen als menschenrechtswidrig bekämpft wurde. Auch die kanonische Strafverfolgungsverjährung wird behandelt. In dem päpstlichen Motu Proprio "Sacramentorum Sanctitatis Tutela" (SST) aus den Jahren 2001 und 2010 wird der Glaubenskongregation die Vollmacht eingeräumt, in Einzelfällen die bereits eingetretene Verjährung nicht beachten zu müssen ("Dispens von der Verjährung"). Letzteres ist mit rechtsstaatlichen Grundsätzen nicht zu vereinbaren.

Es ist dies die im 14. Jahrhundert dogmatisierte Lehre, wonach dem Menschen sowohl im irdischen als auch im jenseitigen Leben ausschlieÃlich die Energien des dreieinigen Gottes zugänglich sind. Die Apokatastasis panton (Wiederherstellung aller Dinge) beinhaltet die Lehre, dass im Jenseits letztlich alle Menschen vergà ttlicht werden. Aus einer formal-dogmatischen Perspektive gilt die Apokatastasis-panton-Doktrin sowohl in der West- als auch in der Ostkirche als heterodox. Allerdings hat sich im Osten die Lehre der Apokatastasis panton seit Gregor von Nyssa und Maximos dem Bekenner als "unterirdische Quelle" erhalten, sodass sie zumindest nach Sergij Bulgakov als "autoritative theologische Meinung" (Theologumenon) gelten kann. Gibt es nach dem Katechismus der rà misch-katholischen Kirche eine ewig dauernde Hà lle (Verdammnis), in der sich die in einer Todsünde Verstorbenen befinden, betet die orthodoxe Kirche gemäà ihrem Glauben an den sich erbarmenden Gott nach Hielarion Alfejew für alle in der Hà lle Festgehaltenen.
