Federal and Nevada laws concerning mining claims on Federal land are based on an 1872 Federal law titled "an Act to Promote the Development of Mineral Resources of the United States." Mining-claim procedures still are based on this law, but the original scope of the law has been reduced by several legislative changes. The Mineral Leasing Act of 1920 provided for leasing of some nonmetallic materials; the Multiple Mineral Development Act of 1954 allowed simultaneous use of public land for mining under the mining laws and for lease operation under the mineral leasing laws. Additionally, the Multiple Surface Act of 1955 made "common variety" materials nonlocatable; the Geothermal Steam Act of 1970 provided for leasing of such resources; and the Federal Land Policy and Management Act of 1976, the "BLM Organic Act," granted the Secretary of Interior broad authority to manage public lands. Most details regarding procedures for locating claims on Federal lands have been left to individual states, provided that state laws do not conflict with Federal laws. Because the details vary from state to state, information given in this publication should not be used as a guide for other states. The 1985 and ·1987 Nevada State Mining Laws are the basis for locating and maintaining claims in Nevada; pertinent portions of these laws are reproduced as Appendix A. Locating a mining claim involves a series of steps, and the location work is not finished until all steps are completed. Every requirement of the Federal and State laws should be understood and carefully followed to insure the claim will be valid.
