Paperback. Condition: New. Print on Demand. This book delves into the concept of 'perpetual cause', an essential requirement for servitudes in Roman law. The author examines the many ways in which this concept has been interpreted, from its traditional understanding as unending duration to more nuanced ideas of naturalness or continuity. By analyzing key texts and considering the historical context, the book argues that the notion of 'perpetual cause' as a universal requirement for servitudes is a misconception introduced by a later commentator. Instead, the author demonstrates that Roman law recognized this principle only in relation to specific servitudes involving water, where it signified the water's consistent flow. This insightful study challenges prevailing assumptions and sheds new light on the nature of servitudes in Roman law, offering valuable insights for scholars and practitioners alike. This book is a reproduction of an important historical work, digitally reconstructed using state-of-the-art technology to preserve the original format. In rare cases, an imperfection in the original, such as a blemish or missing page, may be replicated in the book. print-on-demand item.…
