This essay on European Private Law discusses the progress of Europeanization in the field of Contract Law. It will, in doing so, especially focus on legal education and its contribution to achieve unification and harmonisation of European Union law. But, as the title indicates, in the actual centre of this essay, will be one scholar, who has significantly contributed to the understanding of comparative law and who has increased its status as a recognised legal subject: Basil Markesinis. En septembre 1914, après une « paix armée »l'Europe tombait dans la première guerre mondiale.Sous l'impression de cette guerre si violante où les Européens s'entre-tuaient, RichardCoudenhove- Kalergi fondait l'Union Paneuropéenne pour éviter le retour d'un pareil désastre.Son plan était simple : de réunir les Etats du continent européen dans une même organisation,qui était fondée sur le rapprochement franco-allemand. Dans son livre « Paneurope », paru en1923, Coudenhove-Kalergi posait la question suivante:« L'Europe, dans son morcellement politique et économique, peut-elleassurer sa paix et son indépendance face aux puissances mondialesextra-européennes qui sont en pleine croissance »Ce n'étaient pas les puissances mondiales extra-européennes qui menaçaient la paix enEurope, mais les Européens eux-mêmes. Le contraire d'une Europe unie comme réclamée parCoudenhove-Kalergi se mettait en scène. L'après-guerre était marqué par la croissance dunationalisme allemand qui cherchait une revanche pour la défaite contre les Alliés et le Traitéde Versailles. La Russie qui était devenue bolchevique cherchait à détruire les régimesbourgeois. L'arrivée au pouvoir d'Hitler le 30 janvier, favorisé encore par une terrible criseéconomique, de 1929 à 1933, permettait aux Nazis d'octroyer leur conception d'une Europeaux autres nations. Tous les efforts pour la paix en Europe étaient ruinés.Nonobstant, on ne cessait pas de rêver d'une Europe unie. Mais l'idéal d'unité européennen'était popularisé par certaines élites dans la période de l'entre-deux-guerres. Les milliersd'autres rêvaient après la guerre d'une Europe unifiée et pacifique. Ce n'était qu'après cetemps que les idées d'une organisation de l'Europe en paix sont reprises et seront réalisées.Cet exposé va présenter les plans d'une Europe développés par les Nazis pendant le IIIe Reich(A) et les plans de ceux qui ont lutté contre cette Europe d'une hégémonie allemande et rêvéd'une Europe des nations égaux (B). 40 pp. Französisch.
